Terms and Conditions of Use

⚠️ By downloading, installing, or using the "SkinYzer" mobile application (the "App"), you ("User") agree to be bound by these Terms and Conditions of Use, our Privacy Policy, and our Terms and Conditions of Sale. Do not continue to use SkinYzer if you do not agree to these terms.

SkinYzer is licensed to You (End-User) by OphtaOl SASU, located and registered at 60 Rue François Ier, 75008 Paris, France (hereinafter: Licensor), for use only under the terms of this License Agreement.

By downloading the Application from the Apple App Store or Google Play Store, and any update thereto (as permitted by this License Agreement), You indicate that You agree to be bound by all of the terms and conditions of this License Agreement, and that You accept this License Agreement.

The Application is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind.

All rights not expressly granted to You are reserved.

1. The Application

SkinYzer (hereinafter: Application) is a software created to provide personalized skincare recommendations through AI-powered facial analysis and detailed questionnaires. The App uses a detailed questionnaire and a real-time facial analysis to generate personalized skincare routines, hygiene, and dietary advice.

The Licensed Application is not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subjected to such laws, you may not use this Licensed Application.

2. Scope of License

Unless otherwise stated, OphtaOl SASU and/or its licensors own the intellectual property rights for all material in SkinYzer. All intellectual property rights are reserved. You may access this from SkinYzer for your own personal use subjected to restrictions set in these terms and conditions.

• You are given a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on any Apple or Android Products that You (End-User) own or control.
• Account Creation and Abuse: You are permitted to create only one account. Creating and deleting multiple accounts within a short period of time is prohibited and may result in license termination.
• You may not share or make the Application available to third parties, sell, rent, lend, lease or otherwise redistribute the Application.
• You may not reverse engineer, translate, disassemble, integrate, decompile, remove, modify, combine, create derivative works or updates of, adapt, or attempt to derive the source code of the Application, or any part thereof.
• You may not copy or alter the Application or portions thereof. You may create and store copies only on devices that You own or control for backup keeping under the terms of this license.
• Violations of the obligations mentioned above, as well as the attempt of such infringement, may be subject to prosecution and damages.
• Licensor reserves the right to modify the terms and conditions of licensing.

3. Technical Requirements

• The Application requires a firmware version compatible with your device. Licensor recommends using the latest version of the firmware.
• You acknowledge that it is Your responsibility to confirm and determine that the app end-user device on which You intend to use the Application satisfies the technical specifications.
• Certain functions of the app will require an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but OphtaOl SASU cannot take responsibility for the app not working at full functionality if you don't have access to Wi-Fi or data allowance.
• Licensor reserves the right to modify the technical specifications as it sees appropriate at any time.

4. Description of Services

• Personalized Skincare Routine: The App uses a detailed questionnaire and a real-time facial analysis to generate personalized skincare routines, hygiene, and dietary advice.
• Face Photo Analysis: When you upload a face photo, it is processed in real-time using a third-party API. The photo is immediately deleted from our servers once analysis is complete; only the analysis score is retained.
• Product Scanning: The App also offers a scan of cosmetic products with a scientific analysis of their components and efficacy.

5. Use of Data

You acknowledge that Licensor will be able to access and adjust Your downloaded licensed Application content and Your personal information, and that Licensor's use of such material and information is subject to Your legal agreements with Licensor and Licensor's privacy policy.

When you upload a face photo, it is processed in real-time using a third-party API. The photo is immediately deleted from our servers once analysis is complete; only the analysis score is retained.

6. User Generated Contributions

The Application may invite you to comment, contribute to, or participate in features, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials (collectively, "Contributions"). Contributions may be viewable by other users of the Application and through third-party websites or applications. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary.

Contributions do not reflect the views and opinions of the Licensor, its agents and/or affiliates. To the extent permitted by applicable laws, the Licensor shall not be liable for the Contributions or for any liability, damages or expenses caused by any use of and/or posting of Contributions in this Application.

7. Contribution License

By posting your Contributions to any part of the Application, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, publish, broadcast, reformat, translate, and distribute such Contributions for any purpose.

We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights associated with them. We are not liable for any statements or representations in your Contributions. You are solely responsible for your Contributions to the Application.

8. Liability and Disclaimers

• Accuracy of AI Results: While we strive for accuracy, the App's AI-generated analysis and recommendations are provided "as is" without any warranties. Errors or inaccuracies may occur.
• No Medical Liability: OphtaOl SASU shall not be liable for any direct or indirect damages resulting from the use of the App or reliance on its content. The App is not designed to replace professional medical advice.
• Skin Problems: Licensor takes no accountability and responsibility in case of skin problems (irritation, rashes, redness) that might appear after using recommended products.
• Medical Conditions: Licensor takes no accountability and responsibility in case of misdiagnosed diseases. SkinYzer is not a medical advisor and should not be used to self-diagnose. If you suspect you have a medical condition or a disease, please contact your doctor.
• Third-Party Services: Our use of third-party services is governed by their respective terms. We disclaim any liability for issues arising from their use.

9. Warranty

• Licensor warrants that the Application is free of spyware, trojan horses, viruses, or any other malware at the time of Your download. Licensor warrants that the Application works as described in the user documentation.
• No warranty is provided for the Application that is not executable on the device, that has been unauthorizedly modified, handled inappropriately, or combined with inappropriate hardware or software.
• You are required to inspect the Application immediately after installing it and notify OphtaOl SASU about issues discovered without delay by email.
• If we confirm that the Application is defective, OphtaOl SASU reserves a choice to remedy the situation either by means of solving the defect or substitute delivery.

10. Termination

The license is valid until terminated by OphtaOl SASU or by You. Your rights under this license will terminate automatically and without notice from OphtaOl SASU if You fail to adhere to any term(s) of this license. Upon License termination, You shall stop all use of the Application, and destroy all copies, full or partial, of the Application.

We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated through in-app notifications and updated on our website. Your continued use of the App constitutes acceptance of the updated terms.

11. External Links Disclaimer

Our mobile application may contain links to other websites or content belonging to or originating from third parties. Such external links are not investigated, monitored, or checked for accuracy, adequacy, validity, reliability, availability or completeness by us. WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OFFERED BY THIRD-PARTY WEBSITES.

Application cannot and does not contain skincare advice. The skincare information is provided for general informational and educational purposes only and is not a substitute for professional medical advice. THE USE OR RELIANCE OF ANY INFORMATION CONTAINED ON OUR MOBILE APPLICATION IS SOLELY AT YOUR OWN RISK.

12. Governing Law

These Terms shall be governed by French law. In case of disputes, you agree to resolve them amicably with us. If no resolution is reached, disputes shall be submitted to the competent courts in Paris, France, subject to applicable consumer protection rights.
